1. Acceptance of Terms

Welcome to VivaVoice. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

VivaVoice is a real-time messaging platform with AI-powered translation and text-to-speech capabilities. These Terms govern your use of all features and functionality of our service.

2. Acceptable Use Policy

VivaVoice has ZERO TOLERANCE for objectionable content and abusive behavior.

You agree NOT to use VivaVoice to:

  • Harass, threaten, or abuse other users or engage in any form of bullying or intimidation
  • Post illegal content including content that violates local, state, national, or international laws
  • Share explicit or adult content including pornography, sexually explicit material, or content depicting minors in any inappropriate manner
  • Promote violence or hatred including content that incites violence, promotes terrorism, or advocates for harm against individuals or groups
  • Engage in hate speech including content that attacks or demeans individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Share spam or scams including unsolicited commercial messages, phishing attempts, or fraudulent schemes
  • Violate intellectual property rights including sharing copyrighted material without permission
  • Share private information of others without their consent (doxxing)
  • Impersonate others or misrepresent your identity or affiliation
  • Attempt to harm the service including distributing malware, viruses, or attempting to gain unauthorized access to our systems

3. Content Moderation and Enforcement

VivaVoice takes content moderation seriously. We provide multiple tools to ensure a safe community:

Reporting Objectionable Content

If you encounter content or behavior that violates these Terms, you can report it directly within the app by long-pressing on any message and selecting "Report." All reports are reviewed by our moderation team.

Blocking Abusive Users

You can block any user at any time. Blocked users cannot send you messages or view your online status. To block a user, tap the menu in any conversation and select "Block User."

Our Response to Reports

We commit to reviewing and acting on all reports of objectionable content within 24 hours.

Depending on the severity of the violation, we may:

  • Issue a warning to the user
  • Remove the offending content
  • Temporarily suspend the user's account
  • Permanently ban the user and delete their account
  • Report illegal content to law enforcement authorities

4. User Accounts and Responsibilities

To use VivaVoice, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activity that occurs under your account

5. User-Generated Content

You retain ownership of the content you create and share on VivaVoice. However, by posting content, you grant us a limited license to:

  • Store and transmit your content to deliver our services
  • Translate your content using AI services
  • Display your content to users you choose to communicate with

You represent and warrant that you have all necessary rights to the content you post and that your content does not violate any third-party rights or applicable laws.

6. Intellectual Property

VivaVoice and its original content, features, and functionality are owned by EE3 Labs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Service Availability

We strive to provide reliable service, but we do not guarantee that VivaVoice will be available at all times or that it will be error-free. We reserve the right to:

  • Modify or discontinue any feature or the entire service
  • Perform maintenance and updates
  • Suspend or terminate accounts that violate these Terms

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVAVOICE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Disclaimer of Warranties

VIVAVOICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify and hold harmless VivaVoice, EE3 Labs, and our affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to VivaVoice immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the service will immediately cease. You may delete your account at any time through the app settings or by submitting a data deletion request at vivavoice.org/delete-data.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the app or sending you a notification. Your continued use of VivaVoice after changes become effective constitutes acceptance of the updated Terms.
